New York Free Public Divorce Records

More married couple now files divorce if their marriage is no longer working. With this, an increase in the number of divorce records in New York can be observed, thus access to such documents is also increasing. The Freedom of Information Act has made the document open to the public making it easy for the local residents of the state to request for a copy of their divorce records.

Residents of New York would request for a copy of a divorce record to use it in a number of ways. When dealing with government transactions, one of the documents that are necessary is the divorce certificate. This is especially true if one is processing any insurance matters or one is updating his/her family records in the government files. The divorce certificate is also one of the documents required when a divorced individual applies for marriage again. The marriage application may not be granted if one cannot secure a copy of their legal separation papers.

A public divorce certificate in New York only shows the basic details of the separation. One can only find the date and the place where the couple had their divorce registered. Other vital information about the separation is kept private. The reason for the separation of the couple cannot be found on a public file. Information about who filed the petition for divorce is also kept private together with other vital information such as the property division and child custody. All of this information is kept private since the state of New York respects the privacy of the couple who got divorced.

In New York, divorce records which have been registered since the year 1963 are the only files that the state releases. It would cost $30 in order to request for a copy of a divorce certificate. Although the document is a public document, access to it is limited only to the divorcees and their immediate family. Those who need to access the records of other people need to have an authorization letter to proceed with the request. Another thing to remember when requesting a copy of a divorce certificate is that the basic information that can be found on the file has to be provided since it will be used during the search. One is also required to provide their contact details for verification purposes only.

All of New York's public documents, including the divorce records of the state are kept at the office of the Department of Health under the Vital Records Section. One can personally go to the said office to file the request from there. In cases where the state office cannot provide the requested document, one can seek help from the office of the county clerk where the separation was legalized and see if they can help you with your search. The state office also accepts mailed-in requests but this is not the fastest method in obtaining such document as it can take days or weeks if there are problems with the given search parameters.

Marriage and divorce records of New York are now available online. By doing the request online, the search can be faster and convenient. This means that going to the office is no longer necessary since the search can be done even at the comforts of your own home. There are even websites that offer a free search for the retrieval of divorce records in New York.
